- Redundancy pay uses the National Employment Standards scale. Some awards (for example building and construction, manufacturing) and many agreements and contracts pay more.
- Notice is the minimum under the Fair Work Act. An award, agreement or contract can require more. Paying it in lieu costs the same in wages and super as having them work it out.
- Not included: payroll tax, any award or contract redundancy above the minimum, outplacement, and the cost of a dispute if a redundancy is not genuine.
An estimate for planning, not legal advice. Check the award, agreement and contracts that apply to each employee.
How this works
For each role, the calculator applies the Fair Work Act minimums to the pay and service you enter.
- Notice: weeks from the s 117 table (1 to 4 weeks by service, plus 1 week if the employee is over 45 with at least 2 years’ service) × full weekly pay. Exactly 3 years is still “not more than 3 years”, so it is 2 weeks.
- Super on notice: 12% of the notice pay.
- Redundancy pay: weeks from the s 119 scale × base weekly pay. Nil if you have fewer than 15 employees.
- Annual leave: weeks owing × base weekly pay, plus leave loading if the employee would get it when taking leave (s 90(2)).
- Long service leave: weeks owing under your state or territory law × base weekly pay. Rules on pro-rata payment differ between states, so enter what is owed.
Not included: payroll tax (treatment of termination payments differs by state), redundancy pay above the minimum under an award, agreement or contract, the employee’s tax, outplacement, and very high earners’ super cap.
Redundancy must be genuine: the job is no longer needed by anyone, you followed the consultation terms of the award or agreement, and you couldn’t reasonably redeploy the person in your business or an associated entity. If it isn’t, the employee may be able to claim unfair dismissal.

Questions
How much redundancy pay does the Fair Work Act require?
Under the National Employment Standards, redundancy pay depends on continuous service: 4 weeks for at least 1 year, rising to 16 weeks for 9 to 10 years, then 12 weeks from 10 years (long service leave takes over). It is paid at the base rate of pay for ordinary hours, without loadings, allowances, penalties or overtime.
Do small businesses have to pay redundancy pay?
Not under the National Employment Standards, if the employer has fewer than 15 employees at the time. The count includes the people being made redundant, casuals engaged on a regular and systematic basis, and employees of associated entities, including overseas. An award, agreement or contract can still require redundancy pay, and an employer that became a small business by downsizing may still owe it if it is bankrupt or in liquidation.
How much notice do I have to give?
One week for service of 1 year or less, 2 weeks for more than 1 year up to 3 years, 3 weeks for more than 3 years up to 5 years, and 4 weeks for more than 5 years. Employees over 45 with at least 2 years’ service get an extra week. An award, agreement or contract can require longer.
What rate is payment in lieu of notice paid at?
The full rate of pay the employee would have earned had they worked the notice period, including loadings, allowances, penalty rates and other separately identifiable amounts. Super guarantee applies to payment in lieu of notice.
Is super payable on redundancy pay and leave payouts?
No. Genuine redundancy pay and unused annual leave and long service leave paid on termination are not qualifying earnings, so no super guarantee is due on them. Notice pay, worked or paid in lieu, is.
Do I need to tell anyone if I make a lot of people redundant?
If you are proposing to make 15 or more employees redundant for economic, technological, structural or similar reasons, you must notify Services Australia in writing before the dismissals happen, and notify or consult the union if any affected employee is a member.
